My father died from a wrongful death malpractice. We suit the hospital and a settlement was obtained upon. The Medicaid office is trying to recover all the money for care of my father during six years. Are they supposed to claim the expenses for the care after the injured that caused his premature death only?
If the malpractice complained of resulted in continuous care and multiple procedures over a six year period, you can expect the lien to be substantial. Your lawyer can negotiate it, and has probably requested the claims payment history - and the billing codes for services paid by Medicaid. Medicaid will negotiate, in my experience. You can't avoid having to deal with Govt. liens when public funds have been used to care for the patient...
