Medical Malpractice case involves my husband who was treated incorrectly at a hospital. My husband and I are the plaintiffs. He is now a non-responsive person in a nursing home. Are other members of my family required to be deposed or can they just be a witness.
It can depend on whether their testimony can add anything to what's already known, and whether they are expected to testify at trial. Witnesses to treatment are sometimes deposed - that would include yourself and anyone else who visited him at the hospital. I assume you have a lawyer - he/she can tell you whether the defense attorneys want their deposition testimony.
