My friend was working off the books and got hurt. Can he apply for workers comp?

He got hurt in 2005 and the company said he had no rights for workers comp since he was being paid off the books. At this point and time he is going to need back surgery. Just wanted to know what can he do if anything?

My colleagues are correct. It's situations like this that make me wonder why people put off pursuing their legal rights. Oh well. I wish him the best of luck.
