I was attacked by a unattended pit bull on a New York City street due to the owners negligence which she acknowledged. The dog actually got a hold of my penis puncturing it in the attack with several bite marks around the area, a folley catheter had to be inserted through my penis into my bladder for 7 days. My question is do I have a legal case?
If the dog bit someone in the past, the requisite 'prior notice' of the dog's temperament /propensity would mean the owner would likely to be held liable for injuries the dog inflicted. However, the big question is whether she has homeowner's/renters insurance/sufficient assets to cover your damages. You should definitely talk to a personal injury attorney about this.
