Do I have a legitimate lawsuit against my employer for endangerment or negligence?

July 9, 2018

Question

I was recently in a vehicle accident with a city bus where I was at fault. I do not currently have an open claim for bodily injury but the vehicle I was driving was owned by the company and they had me operating a passenger vehicle that had bad brakes and expired inspection. I believe I was endangered and that the company was negligent, and due to that, I was involved in a collision with a bus with possible bodily injury and dropped from my insurance. Please advise?

Answer

"Possible bodily injury" is no basis for a claim. You need actual damages: IF you sustained serious injury because the brakes failed in the company vehicle, then I'd say you should talk to a lawyer about a worker's compensation claim. It would help a lot if you told the police the brakes failed and it's written in the police accident report...
